Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to April 2008. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between March and April 2008. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April under which they were made (Governing Act).

4. New documents for the 2008-2 Issue of the Canadian enviroOSH Legislation DVD

Documents that will be on the 2008-2 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Division 2 AMENDMENTS

Section 2.A Acts

First Nations Land Management Act (S.C. 1999, c. 24): SOR/2008-51 adds sections 48 to 55 to the Act's Schedule.

Hazardous Products Act: SOR/2008-89 adds item 42 to Part I of Schedule I to the Act and repeals item 12 of Part II. Item 42 refers to jewellery for children under 15 years of age.

Fish Toxicant Regulations (Fisheries Act): SOR/2008-99 amends paragraph 5(b) (name of ministry for Quebec changed).

Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation (Nova Scotia) Act: As a consequential amendment of 2007, c. 14, now proclaimed in force, the definition of "coalbed methane" is added and the definition "gas" is amended in section 2.

Motor Vehicle Act: That part of 2007, c. 45 (Bill 7) which enacts section 100D regarding the prohibition of hand-held cellular telephones is in force April 1, 2008.

Occupational Health and Safety Act: As a consequential amendment of 2007, c. 14, now proclaimed in force, various provisions are made for subsea coal mining. See sections 13, new section 29A (joint occupational health and safety committee), 67, 69, 78, and 82.

Smoke-free Places Act: 2007, c. 54 (Bill 6) now proclaimed in force, adds section 5(2A) and subsection 9(2). The amendments concern the prohibition of smoking when a minor is in a vehicle.

Division 2 AMENDMENTS

Section 2.A Acts

Health Protection and Promotion Act: That part of 2007, c. 10, Sch. F which amends subsection 29(1) (report by laboratory operator) is in force April 1, 2008.

Section 2.B Regulations

Air Pollution - Local Air Quality (Environmental Protection Act): That part of O. Reg. 516/07 which replaces section 34 is in force April 1, 2008. This section concerns emissions into the air which obstructs the passage of light (opacity) by a certain per cent.

Records of Site Condition - Part XV.1 of the Act (Environmental Protection Act): O. Reg. 66/08 amends subsection 5(2) (qualified persons, other than risk assessment) and adds section 7.1 (additional purpose of Registry). Section 5 was to have been repealed on April 1, 2008 but regulation 66/08 rescinds the repeal. A new section 5 is to come into force on October 1, 2009 (see Ontario Gazette, April 19, 2008, p. 99).

Division 2 AMENDMENTS

Section 2.A Acts

Building Act: As a consequential amendment of 2006, c. 58, now proclaimed in force, reference is now made to the Commission des relations du travail. See new sections 129.11.1 and 152.1 plus amended sections 11.1, and 164.1 to 164.5.

Forest Act: Parts of four amending Acts are in force April 1, 2008: 2001, c. 6 (regarding rules governing sustainable forest management); 2003, c. 16 (undertakings by agreement holders); 2006, c. 45 (regarding rules governing forest management activities); 2007, c. 39 (forest management).

Loi sur les forêts

Highway Safety Code: Sections of 2007, c. 40 (Bill 42) in force on April 1, 2008 add sections 5.3 (guidelines to prohibit advertisements from depicting reckless driving), 439.1 (prohibition of hand-held devices while driving - see also section 508 regarding fines), and 516.1 (double fines for speeding). Sections of 1999, c. 66 in force April 1, 2008 replace section 439 (television display screen visible to driver) and adds subsection 621(51) (regulations regarding vehicles equipped with television screens).

Section 2.B Regulations

Regulation respecting occupational health and safety (R.R.Q., c. S-2.1, r.19.01 O.C. 885-2001): O.C. 119-2008 has amended the section references in section 2.

Règlement sur la santé et la sécurité du travail

Safety Standards for Road Vehicles (Highway Safety Code): O.C. 161-2008 amends section 64 (requirements for photometric inspection certificate); adds sections 178.1 & 178.2 in a new Chapter II.1 - Display Screen, regarding the requirements for manufacturer-installed display screens visible to drivers.
